1. User responsibility
Viandly helps people preserve, organize, transform, publish, and share recipe content. Users must have the rights needed for the text, photographs, illustrations, scans, cookbook material, and other content they upload or distribute.
Recipe facts, ingredient lists, expressive directions, stories, photographs, page designs, trademarks, and collections can be treated differently under applicable law. Viandly cannot determine ownership or permission for a user. Source and author attribution should be accurate, but attribution alone does not grant permission to copy or publish protected material.
2. Report a copyright concern
Send a copyright report to support@viandly.com. A useful report should include:
- your name and reliable contact information;
- identification of the copyrighted work you believe has been infringed;
- the exact Viandly URL or other information sufficient to locate the material;
- an explanation of the allegedly infringing use;
- a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or law;
- a statement that the information is accurate and that you are the owner or authorized to act for the owner; and
- your physical or electronic signature.
Reports can involve legal consequences. Do not knowingly make a material misrepresentation about content or authority.
3. How Viandly responds
Viandly reviews sufficiently specific reports, preserves an operational record, and may request missing information. When appropriate, Viandly may disable public or shared access, remove material, suspend an account, notify the affected user, or take another proportionate action.
Viandly may forward the report and contact information to the affected user so that the user can understand and respond to the claim. Viandly does not publish private recipe content merely because a report was received.
4. Counter-notices
If your content was disabled because of a copyright report and you believe that happened through mistake or misidentification, contact support@viandly.com. Include:
- your name, contact information, and physical or electronic signature;
- identification of the removed material and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed through mistake or misidentification; and
- any jurisdiction and service-of-process statements required by the law applicable to the report.
Viandly may provide a counter-notice to the original reporter and may restore access when permitted by applicable law and the reporter does not timely pursue a restraining court order.
5. Repeat infringement
Viandly may suspend or terminate accounts that repeatedly infringe copyright or repeatedly publish material without the necessary rights. Viandly considers the circumstances, valid reports, counter-notices, retractions, and other reliable evidence rather than treating every allegation as a final determination.
